PASSENGER TRANSPORT AND SERVICE AGREEMENT
1-Parties
Bodrum My Turizm Seyahat Travel Agency will be briefly referred to as “Bodrum My Turizm”.
2-Subject With this contract, the parties; They have agreed within the framework of the following contract conditions to provide transfer service from addresses determined by them to airports and vice versa before and after the flight, and to perform this service by Bodrum My Turizm for a fee.
3- Service and Payment Information
3.1. Contract price does not include VAT.
3.2. In private transfer service, requests for different points other than the route(s) specified in the contract; If it is on the route and without waiting, it is included in the price; if it is not on the route, 250 TL for each different point is paid by the passenger in the region.
3.3. If necessary, the agency may change the vehicle type to the same segment vehicle type, provided that it notifies the consumer. If the customer does not accept this change, he has the right to cancel his reservation and receive a full refund of the fee he paid. In this case, the customer has no right to compensation.
3.4. With this document, I authorize the agency to charge my credit card number written below for the services I received.
3.5. The invoice issuance period for the purchased service is 7 days, including the date of purchase, provided that no month is skipped in accordance with the VUK.

6-Number of People: The customer must specify the number of people.
7-General Provisions
Passengers are required to wear seat belts in accordance with the Traffic Law.
Even if the passenger could not sign this contract by virtual pos, mail order, money order or eft for any reason, he learned the terms of the contract that will be valid between the parties through the website or advertisements and accepted to receive the service in the written conditions of the contract.
The customer must have made a reservation no later than 12 (Twelve) hours before the transfer time in order to benefit from the transfer service subject to this contract. On religious and national holidays, New Year's Eve and other public holidays, the reservation must be made at least 48 (forty-eight) hours before the transfer time. The reservation can be canceled by the customer up to 12 hours before the transfer time. In this case, the customer will be refunded. No refund will be made for late reservation cancellations. The route to be followed along the way from the departure point to the destination during the transfer service; It is determined exclusively by Bodrum My Turizm, taking into account traffic, road conditions and other criteria.
The customer is not authorized to change this route. In this context, requests of the passenger to stop at a different location between the determined route and to wait for a while at this location are not accepted. Bodrum My Turizm is only responsible for transporting the customer from a certain point to the airport or from the airport to a certain point. For Onay Vip Tourism Cyprus transfer service; The customer has to allocate a vehicle suitable for the number of passengers and baggage volume determined at the time of purchasing the transfer service online.
Bodrum My Tourism; It accepts and undertakes that all personal accident insurances of all vehicles to be allocated to the service subject to this contract will be fully covered, that the periodic maintenance of the vehicles will be done within their period of time, that materials such as the mandatory spare wheel, first aid material, fire extinguisher, reflector will be available in the vehicle. Bodrum My Turizm will not be responsible for any traffic accident or other reason that may occur during the transfer, if the customer suffers bodily or material damage or if the transported goods are damaged. In such a case, the customer irrevocably accepts and declares that Bodrum My Turizm will not have any responsibility arising from Article 66 of the Code of Obligations and other provisions of the legislation. The articles of this contract that impose responsibility on Bodrum My Turizm are reserved. Despite the allocation of the vehicle suitable for the transfer service, if the number of persons and baggage amount determined by the customer at the time of purchase is exceeded, the transfer is carried out without exceeding the legally determined transportation limits of the vehicle.
Passengers or luggage exceeding the legal limits will not be accepted into the vehicle. If the customer gives up the transfer service for this reason, no refund will be made. The customer is obliged to certify that he is the customer who purchased the service to the Bodrum My Turizm personnel in the vehicle at the transfer point, with the identity documents issued by the legal authorities and the reservation document. The transfer of the customer who does not fulfill this obligation will not be made.
Bodrum My Turizm is not responsible for the situation caused by the change in flight schedules or operational cancellations and/or other delays, which are previously booked by the passenger for the transportation service. Bodrum My Turizm is not responsible for the loss or damage of any belongings left in the vehicle by the customer during the transfer. However, if the forgotten item is discovered later by Bodrum My Turizm staff, it will be delivered to the specified address within the provincial borders of Northern Cyprus on the same day upon the request of the customer.
During the Bodrum My Turizm transfer process, bags, boxes, parcels, etc. he would not accept. The passenger has a maximum baggage allowance of 15 kg per person. In case of loss or damage of the baggage received from the passenger without a declaration of value, the customer does not have the right to demand the service fee as material and moral compensation.
The customer accepts, undertakes and declares that there is no flammable, combustible, explosive, narcotic, fluid, odorous, radioactive substance in the baggage subject to the transfer and that it is prohibited to be transported and kept by the legislation of the Republic of Turkey. If the presence of the items listed in the baggage is noticed by the driver, the baggage in question will not be accepted into the vehicle.
In cases where the following 15 (fifteen) minutes are exceeded during the unloading of the aforementioned items from the baggage, the transfer does not take place due to these reasons, or the customer cannot catch the flight due to lost time, no refund will be made.
In addition, in these cases, the customer cannot claim any receivables or rights under any name against Bodrum My Turizm. in luggage; In case the existence of the above-mentioned substances is noticed, the situation will be immediately reported to the authorized official authorities by Onay Vip Turizm Cyprus. The presence of the listed substances is not noticed by the driver; if the vehicle is detected by law enforcement officers stopping and searching during the transfer; Any damages and losses that Onay Vip Turizm Cyprus may incur due to this reason will be covered by the customer immediately, in cash and at once. The customer's pet transfer requests and the type of pet to be transported will be notified by the customer during the online purchase of the service.
Animal transfer will not be made without such notification. Animal transfers cannot be made alone without an adult customer. The animal to be transferred under these conditions can only be transported in its special cage, in the section determined by Bodrum My Turizm personnel, within the vehicle, under all responsibility of the customer. The transfer of animals whose acquisition, possession and transfer is illegal according to the laws of the Republic of Turkey is not possible under any circumstances. In transfers from a certain point to the airport; Onay Vip Tourism Cyprus declares and undertakes that the vehicle allocated for the transfer will be found at the designated point at the transfer time.
A 15 (fifteen) minute delay from the transfer time will be considered a reasonable delay. In case of delay exceeding 15 (fifteen) minutes, the customer does not have to wait for the vehicle. In this case, the transfer fee is returned to the customer. In transfer points such as site, mass housing; Bodrum My Turizm is not responsible if the 15 (fifteen) minute delay time is exceeded due to the security guards preventing the vehicle from entering the site. If 15 (fifteen) minutes are exceeded in this way and the customer does not wait for the vehicle, no refund will be made.
The customer has to be present with his luggage at the designated point at the transfer time. If the customer is not ready at the transfer point at the transfer time, the vehicle allocated by Bodrum My Turizm is obliged to wait for the customer for 10 (ten) minutes. If the customer does not reach the designated point with their luggage after 10 (ten) minutes, the vehicle is not obliged to wait any longer.
At the transfer point, Bodrum My Turizm personnel are not obliged to leave the vehicle, carry luggage, pet cages, or accompany the passenger to the vehicle to be transferred. Children under the age of twelve will not be transferred without an adult accompanying them. The escort's transfer back to the point of origin is subject to the purchase of the return service on the website. If wheelchair transfer is requested with the customer to be transferred, this will be notified by the customer during the online purchase of the service.
If the customer specifies when purchasing the service online, a baby seat will be placed in the vehicle to be allocated by Onay Vip Turizm Cyprus for 250 TL. Weather and road conditions of the service subject to this contract, vehicle breakdown, not being able to find the address given, sudden health problem related to the customer or the driver , in case of delays or failures due to checks to be made by law enforcement during the transfer and other reasons, and in cases where the passenger cannot catch the flight due to these reasons; Bodrum My Turizm is only obliged to return the prepaid service fee to the customer. The provisions of this contract that stipulate non-refundable situations are reserved. The customer accepts, undertakes and declares that Bodrum My Turizm is not liable for the flight ticket price and other material/moral damage compensation, except for the obligation to refund the price.
In case the customer gives up the transfer during the transfer; Bodrum My Turizm has no obligation to transfer the customer back to the point of origin. If the work schedule of the vehicle does not allow, the customer is left in the nearest residential area in accordance with the traffic rules. In such a case, no refund will be made. During the transfer of the customer; Bodrum My Turizm has no such obligation in case the goods are forgotten or returned to the point of purchase for any other reason and requests the transfer to be completed.
It is up to Bodrum My Turizm to realize this request of the customer to the extent that the work schedule of the vehicle allows. In such a case, Bodrum My Turizm is not responsible for the customer not being able to catch the flight and the poet incurring any other damage, and no refund will be made. Bodrum My Turizm staff is obliged to immediately transfer the passenger to the nearest health unit. The passenger's request to the contrary is not the responsibility of Bodrum My Turizm staff.
The closest health unit may be public health institutions or private health institutions. Bodrum My Turizm is not responsible for any death, bodily damage, material or moral damage that occurs during and after the transfer of the passenger/animal with a health problem to the nearest health unit. Upon the customer's request, the invoice for the service provided will be sent by Bodrum My Turizm to the address specified by the customer.
8-Force Majeure
All kinds of force majeure, natural events, adverse climatic conditions, social events, public movements, negative developments in the working life, any legal or illegal worker or employer movements, strikes, lockouts, union movements and in case they fail to fulfill their obligations under this contract as a result of acts of slowdown, war, armed conflict, revolution, declaration of martial law or state of emergency, conflicts and riots between groups; This contract will remain suspended until the end of the situations/adverse effects listed. The contract will enter into force again with the expiration of the listed situations/negative effects. Failure of the parties to fulfill their obligations as a result of force majeure does not entitle the other party to termination or compensation.
9-Cancellation Conditions and Other Provisions No cancellation, change or refund can be made for any reason on the campaign product purchased by the passenger. Applications made to the bank or Bodrum My Turizm for cancellation and refund requests for overdue reservations are invalid.
10-Authority
In case of any disputes arising from the implementation of this contract, the Laws of the Republic of Turkey will be applied and the Bodrum Courts and Enforcement Offices of the Republic of Turkey will be authorized.
11-Enforcement
Passenger(s) who do not sign the contract but receive the service subject to the contract are deemed to have accepted the terms of the contract when the 3rd persons assigned to register on their behalf read this contract and make an online reservation. In the disputes arising from the contract, the articles of the Road Transport Law No. 4925 and the legislation of the Turkish Republic are applied. The Republic of Turkey Bodrum courts and enforcement offices are authorized. I have read, understood and accepted a copy of this contract issued on our behalf, the date and time of departure, the road transport law, and the information on the website.
